Abstract

Inglise vanasõna ütleb: „ma pole nii rikas, et osta odavaid asju“. Ja teine: et saada odavat ja head asja, tuleb osta 2 asja - üks odav ja teine hea. See vanasõna kirjeldab hästi riigihangete läbiviimist ja tellija soovi saada odavalt head asja, aga silmas tuleb pidada ka seda, et odavaim pakkumine ei taga alati kvaliteeti ega pruugi alati tuua parimat lõppresultaati. Suheldes teedeehitussektoris tegelevate inimestega teehoiutööde kvaliteedist, siis probleeme möönavad kõik. Ja enamasti peetakse probleemide üheks põhjuseks just riigihangete seadusest tulenevat nõuet valida odavaim pakkumine. Seadusest tulenev nõue valida odavaim pakkumine toob endaga kaasa aga olukorra, kus omanikujärelevalve hanked võidetakse hinnaga, mis ei võimalda hanke- ja lepingutingimusi korrektselt täita. Nii on omanikujärelevalve teenust pakkuvad ettevõtted sunnitud rakendama inseneri korraga mitmel objektil ja kuna inseneril ei ole mitmele erinevale objektile korraga järelevalve teenust pakkudes võimalik viibida vahetult tööprotsessi juures, kannatab sealjuures ka tööde kvaliteet. Omanikujärelevalve hange peaks olema selliselt korraldatud, et ei tekiks momenti, kus pakkujad saaksid pakkuda alla omahinna. See aga eeldab seda, et teenuse tellija peaks olema võimeline välja kalkuleerima omanikujärelevalve teenuse tegeliku hinna. Nii oleks võimalik välistada põhjendamatult madalate pakkumiste tegemist. Samuti näeb lõputöö autor ühe võimalusena eeldatavast maksumusest madalamatele ja/või kõrgemate pakkumuste korral anda pakkumusele vähem väärtuspunkte, siis kaob ka huvi pakkuda alla omahinna. Antud juhul tuleks siis hanketingimustes ka avalikustada järelevalve teenuse eeldatav maksumus. Kokkuvõttes võib aga öelda, et seni kuni ei muudeta riigihangete seadust ja sellest tulenevat nõuet valida majanduslikult soodsaim või odavaim pakkumine jäävad üles tõstatatud probleemipüstitused endiselt päevakorda. Kuuldavasti aga on alates 2016. aastast jõustumas uus riigihangete seadus, mis peaks siis andma uued hindamiskriteeriumid pakkumuste hindamiseks. Oluline on selle juures aga see, et me suudaksime negatiivsetest kogemustest õppides neid tulevikus vältida.

Abstract [en]

An English proverb says: "I am not rich enough to buy cheap things". Another is: to get something cheap and good, one must buy two things – one that is cheap and one that is good. This proverb successfully describes conducting a public procurement and the client's wish to get something good inexpensively, but one must remember that the cheapest offer does not always assure quality and might not lead to the best end result. When talking to people in the road construction industry about the quality of road management, everybody admits that there are problems. In most cases, the requirement set by the Public Procurement Act that one must select the cheapest offer is seen as one of the reasons. This requirement, which obliges people to opt for the cheapest offer, causes situations where owner supervision procurements are won at a price which does not make it possible to fulfil the terms of the procurement or the contract. As such, the providers of owner supervision services are forced to appoint their engineers to several projects at a time, which means that the quality of the work suffers as the engineers are not able to be there when the job is being done, since they are offering their owner supervision service on multiple projects simultaneously. Owner supervision procurements should be organized in such a way that one cannot offer the service below cost price. This, however, presumes that the client is able to calculate the actual price of owner supervision. This would make it possible to rule out the submission of unreasonably low offers. The author also sees awarding offers fewer points when the cost is lower and/or higher than the estimate as a solution, as the desire to make an offer below cost price would then evaporate. In this case, the estimated value of the owner supervision service should be set in the procurement conditions. In conclusion, one can say that until the Public Procurement Act is amended and while the requirement to select the economically most profitable or cheapest offer remains, the problems raised by the author will continue to be points at issue. Allegedly, a new Public Procurement Act which will provide new criteria for the evaluation of offers will come into effect in 2016 – but it is important that we learn from our negative experiences in order to avoid them in the future.
